Anewgo seeks to assist homebuyers in identifying new construction homes that match their wants and needs while providing services to aid their buying journey. While Anewgo facilitates the listing process, Anewgo can not guarantee the accuracy of the information that a builder chooses to provide and will not be held responsible for inaccuracy as represented by a home builder or any Partner. Such information may include but is not limited to price, square footage, elevation and floor plan images, and lot size. You acknowledge that you are solely responsible for the verification of all such information. Anewgo does not represent itself as licensed or registered in real estate, appraisal, law, or financial services.
To use the Services you must be at least the age of majority in the state, province, or territory where you live or at least 18 years of age. In using the Services you acknowledge that you are at least the age of majority or 18 and that you have not previously been banned or suspended from using the Services.
Anewgo reserves the right to terminate your account at any time and prevent you from accessing the Services. This most commonly applies to accounts and users who repeatedly make false representations of their identity or their affiliations or represent non-factual comments or reviews as truth. If you have received any incentive for leaving a review it must be fully disclosed.
Some parts of the Services permit users to upload or provide Anewgo with survey inputs, ratings, photos, video, images, data, or post comments or questions that may be displayed on the Services (“User Content”). By submitting User Content you agree that:
Your submitted User Content is truthful and accurate to the best of your knowledge.
You are the creator of the User Content or own the right to the User Content and are legally permitted to post the User Content and will not violate any laws by posting the User Content.
The User Content you submit is solely your responsibility.
Anewgo has the right to use all User Content to copy, distribute, syndicate, display in any public or private form, prepare derivative works of or incorporate into other works, royalty-free, without payment and without notice in connection to the Services.
Anewgo maintains the right to remove or modify User Content at any time.
You may deactivate your account at any time. Deactivating your account will limit your access to the Services. Deactivating your account shall not result in deleting your anonymous data but upon request, Anewgo shall remove your personal information from our database. Unless otherwise expressed in a written contract, you may not represent Anewgo’s Services or Anewgo’s intellectual property as your own. Anewgo owns all rights to the materials and information contained on or in the Services (including source code, data, text, images, and other content). All content on the Services is protected by US and foreign copyright, trademark, and other laws. You may not attempt to reverse-engineer or reproduce the Services.
Use of the Services
As permitted by law, real estate professionals and mortgage professionals can use the Services to provide information and assistance to their clients.
All information and advertisement displayed on the Services are reliable to the best of Anewgo’s knowledge but must be independently verified. Furthermore, all information and advertisements displayed on the Services are subject to the Fair Housing Act, which makes it illegal to create or display advertisements with any perceived preference, limitation, or discrimination based on race, color, religion, sex, handicap, familial status, or national origin. Familial status includes children under the age of 18 living with parents or legal custodians; pregnant women; and people securing custody of children under 18. Anewgo shall not knowingly accept or display any advertisements that are in violation of the Fair Housing Act and will endeavor to ensure all information and advertisements represent equal opportunity housing.
Anewgo endeavors to provide homebuyers with educational content and will at times collaborate with Partners to create such content. Such content may include but is not limited to guest blog posts, podcast or written interviews, social media posts, case studies, and industry reports. While, any such content is true to the best knowledge of both Anewgo and Partners it shall not be viewed as professional, financial, real estate, or any related advice of any kind. It is your sole responsibility to verify any information, or content, provided by Anewgo and its Partners.
- The Tems do not permit you to reproduce, distribute, display or provide access to any part of The Services on Third Party Sites
- The Terms do not permit scrubbing or scraping in any form. You may not manually or use any automated technology to crawl or query The Services for any purpose unless permission has been explicitly granted in the form of a written agreement. Methods of scrubbing or scraping include, but are not limited to, screen and database scraping, spiders, robots, crawlers, and any other automated activity with the purpose of obtaining information from the Services.
- In no case may you use The Services for any unlawful purpose
- You may not use The Services to harm Anewgo, its partners, or its users
- You are prohibited from submitting or uploading any User Content that is unlawful. This includes, but is not limited to, content that infringes on another’s legal rights.
- You are prohibited from uploading any explicit content that is deemed uncivil. This includes, but is not limited to, any form of harassment, hate speech, content designed to attack or deliberately provoke, or contains any unsubstantial allegations.
- You are prohibited from uploading any deceptive content. This includes, but is not limited to, impersonations, misinformation, or misrepresentation of you, your experiences or falsely representing any third party.
- You are prohibited from uploading any mature content. This includes, but is not limited to, obscenities or profanity, sexually explicit content, adult-themed content, or violence and gore.
- We prohibit the distribution or posting of spam and other unsolicited messages, chain letters, pyramid schemes, or similar materials.
- You may not upload any malicious content such as invalid data, viruses, worms, or other software agents
- Any use of Anewgo’s trademarks or likeness without an explicit, written agreement is prohibited
Anewgo works with other organizations and service providers and may have a working business relationship. Most commonly Anewgo may refer homebuyers to organizations that can provide them with other home-buying services. Anewgo along with Partners may benefit financially or otherwise from this referral process.
Use of Third-Party Services
The Services include Third-Party tools and the integration of Third-Party services. All use of Third-Party services is subject to additional terms. These Third-Party terms include, but are not limited to, the following:
In some cases, the Services utilize Stripe Connect to allow buyers to transact with builders. Your use of Stripe is subject to the Stripe Connected Account Agreement, available at https://stripe.com/us/connect-account/legal. Additionally, by using Stripe, you agree not to use Stripe (and the Services generally) for any Prohibited Business purposes, as listed at https://stripe.com/us/prohibited-businesses.
ANEWGO INC PROVIDES THE SERVICES WITHOUT ANY WARRANTY OF ACCURACY, PERFORMANCE, OR SATISFACTORY QUALITY. TO THE FULLEST EXTENT OF THE LAW, ANEWGO MAKES TO REPRESENTATION OF WARRANTIES OR CONDITIONS. YOU UNDERSTAND AND AGREE THAT THE SERVICES ARE PROVIDED “AS IS”, “AS AVAILABLE”, AND “WITH ALL FAULTS” AND THAT ALL RISKS ASSOCIATED WITH THE USE OF THE SERVICES ARE SOLELY WITH YOU. IN USING THE SERVICES, YOU AGREE TO ASSUME ALL RESPONSIBILITY FOR ANY PROPERTY DAMAGE (INCLUDING ANY DAMAGE CAUSED TO YOUR DEVICE OR COMPUTER SYSTEM WHEN ACCESSING THE SERVICES), AS WELL AS ANY LOSS OF DATA RESULTING FROM USING THE SERVICES, COMMUNICATING WITH OTHER USERS, OR DOWNLOADING OR OBTAINING ANY MATERIALS.
Limitations of Liability.
IN NO EVENT WILL ANEWGO INC OR ANY OF THEIR EMPLOYEES, DIRECTORS, OFFICERS, OR REPRESENTATIVES BE LIABLE TO YOU FOR ANY INDIRECT, CONSEQUENTIAL, SPECIAL, INCIDENTAL, OR PUNITIVE DAMAGES ARISING OUT OF, BASED ON, OR RESULTING FROM THESE TERMS, THE AGREEMENT, OR YOUR USE OF THE SERVICES, EVEN IF A PARTY HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. THESE LIMITATIONS AND EXCLUSIONS APPLY REGARDLESS OF WHETHER THE DAMAGES ARISE FROM (A) A BREACH OF CONTRACT, (B) A BREACH OF WARRANTY, (C) NEGLIGENCE, OR (D) ANY OTHER CAUSE OF ACTION, TO THE EXTENT SUCH EXCLUSION AND LIMITATIONS ARE NOT PROHIBITED BY APPLICABLE LAW. IF YOU DO NOT AGREE WITH ANY PART OF THIS AGREEMENT, OR YOU HAVE ANY DISPUTE OR CLAIM AGAINST ANEWGO INC, ITS, EMPLOYEES, DIRECTORS, OFFICERS OR REPRESENTATIVES WITH RESPECT TO THIS AGREEMENT OR THE SERVICES, THEN EXCEPT AS SPECIFICALLY PROVIDED IN THIS AGREEMENT OR WHERE THE LAW REQUIRES A DIFFERENT STANDARD, YOUR SOLE AND EXCLUSIVE REMEDY IS TO TERMINATE YOUR ACCOUNT FOR THE SERVICES, AND/OR CEASE THE USE OF THE SERVICES.
